Balloon Bats — Terms of Service

1) Overview

These Terms of Service ("Terms") are an agreement between Mayflower Worlds, LLC, a North Carolina limited liability company ("we," "us," "our"), and you. They cover your use of:

• Balloon Bats and any related tests or betas (the "Games"),
• our website balloonbatsvr.com and subdomains (the "Website"), and
• other services we provide (together, the "Services").

By using our Services, you agree to these Terms and to our Privacy Policy at https://balloonbatsvr.com/privacy.html. If you do not agree, please do not use the Services.

2) Age Requirements

Per Meta's policies:

• Balloon Bats can be played on Quest 2, Quest 3, Quest 3S, and next-gen headsets.
• Players ages 10–13 must use a Parent-Managed Account.
• Players 13 and older may accept these Terms on their own.

If you are under your local age of majority, a parent/guardian must review and accept these Terms. They are responsible for your use, including purchases.

If we discover underage use without parental consent, we may disable the account.

3) Accounts

You need a Meta/Quest® account to play. These accounts are managed by Meta, not us, and subject to Meta's terms. You are responsible for your account and any activity on it.

4) Purchases

Our Games may include virtual currency called Bat Bucks and in-game cosmetics ("Virtual Items").

• Virtual Items are for personal use only and have no real-world value.
• They cannot be sold, traded, or transferred.
• All purchases are final and non-refundable unless required by law.
• We may change or remove Virtual Items at any time.

5) Fan Art and Contributions

We love community creations. If you share artwork, designs, or ideas with us and ask that we include them in the Game, you agree we can use them freely without compensation or credit, unless we make a separate written agreement.

6) Rules of Use

When using our Services, you agree not to:

• Break the law or violate others' rights.
• Harass, threaten, or harm others.
• Cheat, exploit, or tamper with accounts or the game.
• Share accounts or sell Virtual Items.
• Spread malware or disrupt servers.

We may suspend or remove users who break these rules. Refunds are not provided for banned accounts.

7) Health and Safety

Virtual reality can involve risks:

• Take breaks every 30 minutes.
• Stop if you feel dizzy, sick, or in pain.
• Keep a clear 6×6 ft play area and be aware of your surroundings.

We are not responsible for injuries, health issues, or property damage from unsafe play.

8) Streaming and Content Creation

You may share gameplay (e.g., on YouTube or Twitch) as long as you:

• Follow these Terms,
• Follow platform rules,
• Don't claim endorsement or official partnership without permission.

We can revoke this permission at any time.

9) Playtests

If invited to a test or beta, you may access unfinished features. These are confidential and not to be shared publicly. We may end tests at any time.

10) Ending Use

We may suspend or terminate your access if you break these Terms or for any reason. Sections about ownership, purchases, liability, and dispute resolution will continue to apply.

11) Disclaimer

Our Services are provided "as is" with no guarantees. We are not responsible for interruptions, errors, or user behavior.

12) Limitation of Liability

We are not liable for indirect or special damages (like lost data or profits). Our total liability is limited to what you've paid us in the last 6 months.

13) Dispute Resolution

If you have a problem, please email [email protected] first so we can try to resolve it together. If we cannot, any disputes will be handled in the courts of Wake County, North Carolina, under North Carolina law.

14) Entire Agreement

These Terms and our Privacy Policy make up the whole agreement between you and us.
